Please read the following Privacy Policy (“PP,” “Policy” or “Agreement”) carefully before viewing or using any services, features, content or applications offered by ONVI, INC., an Illinois Corporation, (“ONVI,” “we,” “us” or “our”) via ONVI.ME (as “Site,” “Software” or collectively as “Service(s)”).

1. Preamble and General Principles

A. This Policy applies to both those who access the Site but do not have accounts (“Visitors”) as well as those who register to make purchases through the Site (“Consumers”) collectively (“User(s),” “Parties,” “You,” or “Your(s)”). In order to use the Services, you must first agree to the TOU. You may not use the Services if you do not accept the TOU.

ONVI, INC. (“ONVI”) has created this privacy statement in order to demonstrate our respect for Users, and our firm commitment to, privacy. This Policy describes our practices on tayloredwines.com (the “Site,” “Software” or “Service(s)”) where it is posted. It also applies to SMS messages, cloud storage, and emails.

The following information is designed to help You, as the User, understand how we collect, use, disseminate and safeguard the information You provide to us while accessing and using our Services. You agree to the terms in this policy when You use this Services or by clicking to accept where the option is made available to You by ONVI in the user interface of the Services. If You do not agree with our information practices, please do not access or use the Services.

B. This Policy does not apply to our use of employee information. It also does not apply to information we collect from You offline.

2. Revisions to this Policy.

This Policy may change from time to time, without notice other than appearing on the Site. ONVI reserves the right to revise, amend, or modify this Policy and our other policies and agreements at any time and in any manner. Your continued use of the Services constitutes your agreement to all revisions of the Policy. Users should note the date of last revision to this Policy, which appears at the top of this Policy. This Policy was last revised on January 1 st, 2016.

If the “last modified” date remains unchanged after a User has clicked the “refresh” button on his/her browser, the User may presume that no changes have been made since the last reading of the Policy. A changed “last modified” date indicates that this Policy has been updated or edited, and the updated or edited version supersedes any prior versions immediately upon posting.

3. Types of Data.

“Personal Data” means data that allows someone to identify or contact You, including, for example, your name, address, telephone number, e-mail address, as well as any other non-public information about You that is associated with or linked to any of the foregoing data. It does not include personal information that is encoded or Anonymous Data.

“Sensitive Data” is additional data that would be included would include data revealing race, ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, or information on criminal or administrative proceedings other than in the context of pending legal proceedings.

“Anonymous Data” means data that is not associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons. We collect Personal Data and Anonymous Data.

A. General Site Purpose, Data/Information Collection and Disclosure.
While the Site is designed so that Users may generally browse it without providing any Personal Data, certain areas of the Site will require at a minimum, your email address. ONVI uses your Personal Data for the purposes it was submitted by You to ONVI and to send You news, publications and invitations that may be of interest to You as well as for the functionality and general usage of the Services given the essential need to use and send tasks through electronic mail.

Other general uses of the Personal Data You submit to us is used to respond to requests that You make.

We may use or disclose your Personal Data, including but limited to, the ways and for any reason if, in our sole discretion, we believe that it is reasonable to do so, including the following:

  • Registration: allow You to register for our Services and to administer the registration;
  • Improve Customer Service: Information Users provide helps us respond to customer service requests and support needs more efficiently;
  • Communication: to communicate with You about our Services and related issues;
  • Improve Our Services: We may use feedback You provide to improve our content, products, services, etc.;
  • Transaction information: may be shared and may be provided to other trusted third parties as necessary to process and fulfill orders, and to help enable ONVI to provide better User services and offerings. For example, ONVI will require your name, email address, shipping address, phone number and credit card information to process most orders through the Site via our Payment Processor.
  • Administrative: to maintain and administer our Services such as employing other companies and individuals to perform services to maintain and operate the Site, and to maintain certain features on the Site, as well as to comply with our legal or internal obligations and policies of which may include disclosure to employees, consultants, affiliates or other businesses or persons for the purpose of processing such information on Our behalf. In such circumstances, we require that these parties agree to protect the confidentiality of such information and to comply in all respects with this Policy.
  • Legal requirements: to transfer information to others as described in this policy or to satisfy our legal, regulatory, compliance, or auditing requirements;
  • Periodic electronic mail: We may use the email address Users provide to send the User information and updates, Services, and/or other requests. If Users should opt-out of our mailing list if they would not like to receive emails that may include our news, updates, related Services information, etc. If at any time the User would like to unsubscribe from receiving future emails, they may do so through the links within the email of by contacting us via the Site and allowing us a reasonable amount of time, according to the laws where the User is located, to comply with the unsubscribe and to scrub the User from our mailing list.
  • We may also share non Personal (such as anonymous User usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality of the Services. Similarly, we may share Sensitive Data so long as it is not aggregated with Personal data and therefore cannot be connected to any person.

    4. Commitment to Children’s Protection.

    The Site is not targeted or intended for anyone under the age of 13. If any and all Personal Data is collected or input by a child under the age of 13 because they have used means to mislead and conceal their true age, it will be deleted according to any applicable laws such as the Child Online Privacy Protection Act (COPPA).

    5. Your Choices.

    Users can opt out of marketing emails or text messages by following the instructions in any marketing emails or text messages they receive. Users can also opt-out by sending us an email. To request changes to or to review information, please send us an email. You may also email us to have your personal information deleted where possible.

    A. Users can choose not to provide personal information. However, if Users do not provide us with information some Service features may not work. Users can also choose to configure their browser not to accept cookies. If You do so, however, some parts of the Services may not work, for example the ability to remain logged in.

    B. Users can control cookies and tracking tools. Your browser may give You the ability to control cookies or other tracking tools. How You do so will depend on the type of tool. Certain browsers can be set to reject browser cookies. To control flash cookies, which we may use on certain websites from time to time, You can go here. Why? Because flash cookies cannot be controlled through your browser settings. If You block cookies on your browser, certain features on the Site may not work.     C. Some web browsers have a “Do Not Track” feature. This feature lets You tell websites You visit that You do not want to have your online activity tracked. These features are not yet uniform across browsers. Our Services are not currently set up to respond to those signals.

    6. Users Outside the United States.

    The Services are only intended for residents of the United States. However, if a User of the Services resides in a country other than the United States, your accessing or using the Services in any way constitutes your agreement that (a) We may process your Personal Data for the purposes identified in the Policy, and (b) your Personal Data may be transferred to and processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Data may be less stringent than the laws in your country. By providing your Personal Data You consent to such transfer.

    7. California Residents.

    Residents of the State of California have the right to request a list of all third parties to which ONVI has disclosed certain information during the preceding year for the third parties’ direct marketing purposes as stated in California Civil Code Section §1798.83.

    However, it is our policy to not disclose personal information in any way other than for the purposes included in this Policy. In the future if the Policy changes in this respect, You have given us your email address to contact You with any material changes, and You are a California resident and want such a list, ple:

    8. Cookies Policy.

    A “cookie” is a small data file that can be placed on your hard drive when You visit certain websites. A “web beacon” is a small, transparent graphic image placed on a website, which allows the site to record the actions of a visitor opening the page that contains the beacon. ONVI uses cookies to collect, store, and sometimes track information for statistical purposes to improve Services performance and delivery and may in the future use web beacons to do the same.

    For example, we may use cookies to save login credentials. These cookies do not enable third parties to access any of your customer information. Advertisers and partners may also use their own cookies. We do not control use of these cookies and expressly disclaim responsibility for information collected through them.

    Your browser may give You the ability to control cookies or other tracking tools. How You do so will depend on the type of tool you use. Certain browsers can be set to reject browser cookies.     9. Online Advertisements.

    While ONVI does not currently feature online advertisements and it does not intend to in the future, We have the right to do so in the future. At such time, We would not be responsible for use of information by third-party websites of which are not affiliated with ONVI.

    10. Security.

    ONVI has implemented SSL encryption and followed other appropriate technical measures to protect against the risks of unauthorized access to, erroneous disclosure of, and unlawful interception of Personal Data. But, the Internet is not 100% secure. While ONVI uses commercially reasonable physical, managerial and technical safeguards to preserve the integrity and security of your data and information, we cannot promise that your use of our Services and data You provide will be completely safe for all time and under all circumstances. We encourage You to use caution on the Internet.

    11. In the Event of Merger, Sale or Bankruptcy.

    In the event that ONVI is acquired by or merged with a third party entity, we reserve the right to transfer or assign the information we have collected from Users as part of such merger, acquisition, sale, or other chance of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally We may not be able to control how your personal information is treated, transferred, or used.

    Complaints will be resolved internally in accordance with our complaints procedures. While the Site is intended only for residents of the United States, if You live in the European Union or Switzerland and efforts to resolve a matter between You and ONVI internally are unsatisfactory, the complaint may be submitted to the American Arbitration Association, which has been selected as the independent recourse mechanism to resolve complaints and disputes relating to treatment of data originating in the European Union or Switzerland under this policy.

    This Policy does not supersede the Terms of Use governing your use of the Services. Any conflict between the two shall be resolved in favor of the Terms of Use.
